The authorities' deadlines and the consent

At a glance
- Ten working days for requests. The authority of dispatch asks for missing information no later than ten working days after submission. The notifier then has ten working days to answer.
- 30 days after completion. Within 30 days of the notice that the notification is complete, the authorities decide: consent, consent with conditions, or objection.
- Tacit consent. If a transit authority raises no objection within the 30 days, its consent can be assumed.
- One year at most. A consent is valid for one year at most. The waste must arrive within it and be treated within one year of receipt.
- When something isn't right. If the composition differs, conditions are ignored or the guarantee ends, the authorities withdraw their consent.

If nothing, or not enough, comes in answer to the last request, the authority decides that the notification is not valid and will not be processed further Art. 8(5), (10). Once the notification is properly completed, the authority of destination informs everyone immediately Art. 8(12).
The decision
Within 30 days of that notice, the authorities of destination, dispatch and transit decide, each with reasons Art. 9(1):
- consent without conditions,
- consent with conditions, for example on transport within their territory Art. 10,
- an objection, for recovery Art. 12,
- no consent, if the conditions for disposal are not met Art. 11.
Tacit consent may be assumed for transit authorities that raise no objection within the 30 days Art. 9(1). If objections are not resolved within 30 days, the notification ceases to be valid Art. 12(4).
How long the consent lasts
- one year at most; it ends with the earliest period of validity any of the authorities sets Art. 9(4);
- shipping starts only once the duties under Art. 16(1) and (2) are met, and only within the validity; the waste must have reached the facility before it ends Art. 9(5);
- recovery or disposal is completed no later than one year after receipt, unless the authorities set a shorter period Art. 9(6).
Withdrawal
The authorities withdraw their consent at the notifier's request or when they learn that the composition is not as notified, conditions are not respected, the waste is not treated in line with the facility's permit, it is shipped or treated differently than stated, or the guarantee or the contract has ended Art. 9(7). The shipment may then not continue, and the take-back rules apply Art. 9(9).
Checklist
- Requests are answered within ten working days, or an extension is requested with reasons.
- The calendar shows the day the notification was completed and the end of the 30 days.
- We know how long the consent is valid, and the last delivery arrives before then.
- Treatment within one year of receipt is agreed with the facility.
- Everyone involved knows the authorities' conditions.
